These Terms of Service ("Terms") govern your access to and use of B1Z.GURU (the "Platform" or "Service"), a business management SaaS application operated by Hum4nity ("we", "us", or "our"), a company registered in England and Wales.
By creating an account, accepting an invitation, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are accepting these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity.
You must be at least 18 years old and capable of entering into a legally binding contract to use the Platform. The Platform is intended for business use only and is not directed at consumers.
Access is granted only to invited or approved Subscribers. You are responsible for keeping your login credentials secure and confidential. You must notify us immediately if you suspect unauthorised access to your Account.
During the Pilot Programme, access to the Platform is granted on a limited, invitation-only basis. Pilot Programme terms may differ from standard subscription terms and are subject to change as the product evolves. We reserve the right to modify, limit, or terminate Pilot Programme access at any time with reasonable notice.
The Platform is offered under three plan tiers: Free, Pro (£49/month), and Agency (£149/month). Plan details including feature limits are set out on the Pricing page and may be updated from time to time.
Subscriptions are billed in advance on a monthly basis unless an annual billing option is selected. All prices are stated exclusive of VAT. Where applicable, VAT will be added at the prevailing UK rate.
Payments are processed securely via Stripe. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis for the applicable subscription fee until you cancel.
Where a free trial is offered, access to paid features is available for the stated trial period at no charge. At the end of the trial, your account will revert to the Free plan unless you have entered valid payment details and selected a paid plan. We are not obliged to provide a free trial on any particular occasion.
You may cancel your subscription at any time from within your Account settings or by contacting us at rajia@hum4nity.com. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the period expires.
No refunds are issued for partial billing periods unless required by applicable law. If you believe you have been charged in error, contact us within 14 days of the charge.
You may use the Platform solely for lawful business purposes consistent with its intended functionality. You agree not to:
You retain ownership of all Content you upload to the Platform. By uploading Content, you grant us a limited, non-exclusive licence to store and process that Content solely for the purpose of providing the Service to you.
You are solely responsible for ensuring that any Content you upload, and any use of the Platform's outreach or campaign features, complies with applicable data protection law (including UK GDPR), anti-spam law (including PECR), and any other applicable regulation. We are not responsible for the accuracy or legality of your Content.
We process personal data in accordance with our Privacy Policy and applicable UK data protection law. Where you upload personal data of third parties (e.g. contacts, leads), you act as Data Controller and we act as Data Processor. Our data processing activities on your behalf are governed by our Privacy Policy, which forms a data processing agreement for the purposes of UK GDPR Article 28.
All software, design, trade marks, and proprietary content comprising the Platform are owned by Hum4nity or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform during your Subscription solely for its intended purpose. Nothing in these Terms transfers any intellectual property rights to you.
We will use commercially reasonable efforts to maintain Platform availability. However, we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, updates, or changes to the Platform at any time. Where a material feature is removed or substantially degraded on a paid plan, we will provide reasonable advance notice.
Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the Service, and not to disclose such information to any third party without prior written consent, except as required by law.
The Platform is provided "as is" and "as available". We make no warranty, express or implied, that the Platform is fit for any particular purpose, free from errors, or that results obtained from its use will be accurate or reliable.
To the maximum extent permitted by applicable law:
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
You agree to indemnify, defend, and hold harmless Hum4nity and its officers, employees, and agents from and against any claims, damages, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Platform in breach of these Terms; (b) your Content; or (c) your violation of any applicable law or regulation.
We may suspend or terminate your Account immediately if you breach these Terms, fail to pay any amount due, or if we have reasonable grounds to believe that your use of the Platform poses a legal, security, or reputational risk. We may also terminate the Service on 30 days' written notice.
On termination, your right to access the Platform ceases immediately. You may request a data export of your Content within 30 days of termination, after which we may delete your data in accordance with our data retention policy.
We may update these Terms from time to time. Where changes are material, we will notify you by email or via a notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
These Terms and any dispute or claim arising from or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts of England and Wales.
